Terms of Service

These Terms govern your access to and use of the PIMSPlus platform, website, and related services.

Welcome to PIMSPlus. By subscribing to or using PIMSPlus, you agree to comply with these Terms. If you do not agree with any part of these Terms, you should not use our services.

1. About PIMSPlus

PIMSPlus is a cloud-based clinic management system designed to help healthcare providers manage patient records, appointments, billing, and other clinic operations.

Our services are intended for authorized clinic owners, administrators, and healthcare professionals acting on behalf of a clinic or healthcare organization.

2. Eligibility

You must be at least 18 years old and authorized to represent your clinic or organization to create and use a PIMSPlus account.

PIMSPlus is not intended for use by minors.

3. Subscription and Payment

PIMSPlus is offered through an annual subscription plan.

Current pricing is PHP 9,600 per year, billed annually. Pricing may be updated from time to time, and any changes will apply only to future subscription periods.

Subscription requests are processed after payment confirmation. Once payment has been received, PIMSPlus will provide account access credentials and the corresponding system URL.

All payments are non-refundable unless otherwise required by applicable law.

Failure to complete payment may result in delayed account activation, suspension, or non-provision of access to the platform.

Subscriptions are valid for the agreed subscription period and may be renewed upon payment of the applicable renewal fees.

4. User Accounts and Security

You are responsible for maintaining the confidentiality and security of your account credentials.

After receiving your initial login credentials, you are encouraged to update your password and implement appropriate security measures within your organization.

You are also responsible for managing user access within your clinic and ensuring that only authorized personnel can access patient and clinic information.

Any activity performed using your account will be considered your responsibility.

5. Data Privacy and Regulatory Roles

Clinics remain the Personal Information Controller (PIC) of all patient and clinic information stored within PIMSPlus.

PIMSPlus acts as a Personal Information Processor (PIP) and processes such information only as necessary to provide the services requested by the clinic and in accordance with applicable laws.

Clinics are responsible for obtaining any required patient consents and complying with applicable healthcare, privacy, and recordkeeping regulations.

6. Data Ownership

Your clinic retains full ownership of all patient records, clinic information, and other data entered into PIMSPlus.

PIMSPlus does not claim ownership of your data.

PIMSPlus shall not access, use, or disclose patient information except as necessary to provide services, comply with legal obligations, maintain system security, or as otherwise authorized by the clinic.

Upon termination of your subscription, you may request a copy or export of your clinic's data, subject to reasonable processing requirements and verification procedures.

7. Data Backup and Recovery

PIMSPlus maintains commercially reasonable backup and recovery procedures designed to protect customer data.

However, customers acknowledge that no backup system is completely error-free and are encouraged to maintain copies or exports of critical records where appropriate.

PIMSPlus shall not be liable for losses arising from events beyond its reasonable control affecting backup systems.

8. Service Availability

PIMSPlus aims to maintain commercially reasonable service availability but does not guarantee uninterrupted, error-free, or continuous operation of the platform.

From time to time, the platform may be temporarily unavailable due to scheduled maintenance, software updates, system improvements, security measures, third-party service interruptions, or unforeseen technical issues. Where reasonably practicable, advance notice of scheduled maintenance will be provided.

While PIMSPlus takes reasonable steps to minimize service disruptions and restore services promptly, we shall not be liable for any losses, damages, or interruptions resulting from temporary service unavailability or circumstances beyond our reasonable control.

9. Suspension of Services

PIMSPlus may temporarily suspend access to the platform if:

  • Required for maintenance
  • Necessary to protect system security
  • Required by law
  • Payment obligations remain outstanding
  • User activities threaten system integrity

10. Acceptable Use

Users agree not to:

  • Use the platform for any unlawful purpose.
  • Attempt to gain unauthorized access to the system.
  • Interfere with the operation or security of the platform.
  • Upload malicious software, viruses, or harmful code.
  • Reverse engineer, copy, modify, or distribute any portion of the platform without written permission.

PIMSPlus reserves the right to suspend or terminate accounts that violate these Terms.

11. Intellectual Property

PIMSPlus, including its software, design, branding, documentation, and related materials, remains the exclusive property of PIMSPlus and its licensors.

Users shall not copy, reproduce, adapt, decompile, reverse engineer, disassemble, create derivative works from, or otherwise attempt to replicate the functionality, design, workflows, documentation, or underlying technology of PIMSPlus except as expressly permitted by law.

12. Confidentiality

Each party agrees to protect confidential information received from the other party and to use such information only for purposes related to the services.

Confidential information includes non-public information regarding PIMSPlus, including documentation, pricing arrangements, training materials, product plans, and similar business information.

Users agree not to disclose such information to third parties without prior written consent from PIMSPlus.

Confidential information does not include information that is publicly available or independently developed without reference to the other party's information.

13. Healthcare Disclaimer

PIMSPlus is a software platform intended to assist healthcare providers with administrative and record-management functions.

PIMSPlus does not provide medical advice, diagnoses, treatment recommendations, or clinical services.

Healthcare professionals remain solely responsible for all patient care decisions, medical judgments, diagnoses, treatments, and record accuracy.

14. Limitation of Liability

PIMSPlus is provided on an "as available" basis.

To the fullest extent permitted by law, PIMSPlus shall not be liable for any indirect, incidental, consequential, or special damages arising from the use or inability to use the platform.

To the maximum extent permitted by law, the total liability of PIMSPlus arising from or related to the services shall not exceed the amount paid by the customer during the twelve (12) months immediately preceding the event giving rise to the claim.

15. Force Majeure

PIMSPlus shall not be liable for delays or failures caused by circumstances beyond its reasonable control, including but not limited to natural disasters, power outages, internet disruptions, cyberattacks, government actions, labor disputes, or failures of third-party service providers.

16. Termination

Users may discontinue their subscription at any time.

PIMSPlus may suspend or terminate access to the platform if a user violates these Terms, engages in unauthorized activities, or fails to meet payment obligations.

Upon termination, users may request an export of their data in accordance with our data retention and verification procedures.

Customer data will thereafter be retained in accordance with the Privacy Policy and applicable legal requirements.

17. Changes to These Terms

PIMSPlus may update these Terms from time to time to reflect changes in our services, legal requirements, or business operations.

Updated versions will be posted on our website, and continued use of the platform after such updates constitutes acceptance of the revised Terms.

18. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the Republic of the Philippines.

Any disputes arising from these Terms shall be subject to the jurisdiction of the appropriate courts in the Philippines.
